Controlled substance

“Controlled substance” means any substance listed in schedule I, II, III, IV or V of section thirty-three hundred six of the public health law other than marihuana, but including concentrated cannabis as defined in paragraph (a) of subdivision four of section thirty-three hundred two of such law. NY Penal Law §220.00(5)

Controlled substances are listed in schedules in Public Health Law §3306. In 2012, this law was amended to move hyrocodone (found in pain medicine such as vicodin) from Schedule III to the more restrictive Schedule II.
