What will happen to my driving license from a DWI?

by Seth Azria on 7/11/2017

The impact on a driving license from a DWI is two fold.

1) Prompt Suspension

Due to New York's prompt suspension law a judge may suspend your license at your arraignment, which is typically your first appearance in court. The judge may permit driving in limited circumstances while your case is pending upon the showing of an extreme hardship.  Preparing to make a motion to the court for a Hardship Privilege is one of the very first things we will do as your lawyer.  This application will include an affidavit from a person who knows you and your schedule- typically a co-worker or family member.

2) Suspension or Revocation if Convicted

A DWI or DWAI conviction will cause your license to be suspended or revoked for a period of time. Following a conviction, you may be eligible for a Conditional License which allows you to drive to work, school, medical/treatment appointments, and in a few other limited circumstances.  Typically, a driver will be eligible for a conditional license if you are eligible and participate in the New York Drinking Driver Program.

The impact of DWI, and especially with a prior conviction, upon a driving license is complicated. We invite you to call (315) 364-1155 to discuss your case and discover precisely what you might be facing.
