1. “Sell” means to sell, exchange, give or dispose of to another, or to offer or agree to do the same. NY Penal Law §220.00(1)

The definition of "sell" under the New York law is far more broad than the non-legal or common sense definition of the word which is to give or hand something over in exchange for money.

To "sell", as defined by law, does not require an exchange of money. And because the definition includes an agreement to sell, a person is deemed to "sell" if the person had both the intent to sell and and the ability to proceed with the sale.
